| SHOOTING SUSPECT ARRESTED |

Detective Gauthier located suspect from the June 29th shooting at Parkside Gardens Apartments.

On Monday, June 29, 2009, a shooting occurred at Parkside Gardens Apartments, 621 NW 2nd St., Ocala, resulting in injury to one person. On 06/29/09, officers with the Ocala Police Department responded to Parkside Gardens Apartments, 621 NW 2nd St., in reference to a shooting. A short time after having arrived on scene, information was received that a victim with a gunshot wound was in the emergency room of Monroe Regional Medical Center (MRMC). This victim was b/m Toney Terrell Franklin, DOB 11/02/88, and his wound was found to have been non-life threatening.
Through further investigation by Detective Doug Ellzey it was able to determine that this had been a robbery attempt by Franklin and others, and that he had been accidentally shot by one of his accomplices. According to witnesses, and one of the victims of the robbery attempt, a green vehicle with 3 unknown black males was in front of apartment #1202. One victim was talking to these subjects when 3 unknown subjects with their faces covered came around the side of the building and went directly to the vehicle. Franklin was one of these subjects who approached, produced a handgun and attempted to rob the occupants of the vehicle. The victim, who lives in the area, attempted to intervene by grabbing the gun and telling Franklin that "he was not going to do this."
During this time, one of the other subjects who'd approached the vehicle opened fire. This subject, identified as b/f Passion Jackson, DOB 12/14/92, shot Franklin in the shoulder, as he was standing in front of her. Jackson was identified by witnesses as the subject who fired the gun and shot Franklin.
After being treated for his gunshot wound at the hospital, Franklin was placed under arrest and transported to the Marion County Jail. He was charged with 1 Count of Aggravated Assault (Firearm), 1 Count of Possession of a Firearm by a Convicted Felon, and 1 Count of Possession of a Firearm During a Felony. Bond was set at $30,000.00.
A warrant was issued for the arrest of Passion Jackson for 1 Count of Aggravated Battery with a Firearm. She was located by Detective Miguel Gauthier at Parkside Gardens Apartments on July 28, 2009. She was arrested for the outstanding warrant and for an additional misdemeanor charge of Possession of Marijuana Under 20 Grams. Jackson was transported to the Juvenile Detention Center.
